GENERAL TERMS AND CONDITIONS OF SALE (GTC)

1. Purpose and Application

These Terms and Conditions govern the sale of unique works of art created by Mr. Jamain Franck (Mister Melody), offered via the website mistermelody.art. They apply to all orders placed directly with the artist (by email, telephone, or via the contact form).

2. Artwork Characteristics and Proof of Purchase

Each artwork is an original and unique creation. The price, dimensions, and technique (e.g., spray paint on audio cassettes, stencil) are specified on the Gallery page. A certificate of authenticity will be provided to the buyer for every purchase.

3. Price and Payment Terms

The prices of the artworks are listed in Euros (€) on the website's gallery. Shipping and insurance costs for fragile artworks are communicated to the buyer before final order confirmation. Payment is made by bank transfer or another method agreed upon with the artist.

4. Delivery and Shipping (Fragile Works)

The artist will ship the artwork upon receipt of full payment.

Packaging: The artwork is packaged using specialized methods (wooden crates, protective foam) to ensure its integrity.

Shipping and Insurance: Fragile artworks are shipped by specialized carriers (such as DHL, UPS, or art delivery companies) with Ad Valorem insurance (covering the full value of the artwork).

5. Right of Withdrawal (French Law)

In accordance with Article L221-18 of the French Consumer Code, the consumer has a period of fourteen (14) clear days from receipt of the artwork to exercise their right of withdrawal. The buyer must inform the artist of their decision by email or mail. The artwork must be returned, in its original packaging and in perfect condition, at the buyer's expense.

Legal Notice: Failure to inform the artist of this right exposes them to an administrative fine of €15,000.

6. Disputes and Applicable Law

These Terms and Conditions are governed by French law. In the absence of an amicable settlement, any dispute will be submitted to the competent French courts.
